Terms of use

1. Acceptance of Terms

By creating an account, accessing, or using Bllod ("the App," "Service," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy (available at https://bllod.com/privacy-policy).

If you do not agree to these Terms, you may not access or use Bllod.

By creating an account, accessing, or using Bllod ("the App," "Service," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy (available at https://bllod.com/privacy-policy).

If you do not agree to these Terms, you may not access or use Bllod.

2. Eligibility

By using Bllod, you represent and warrant that:

  • You are at least 16 years of age

  • If you are under 18, you have obtained parental or guardian consent to use the App

  • You have the legal capacity to enter into this agreement

  • You will use the Service only for lawful purposes and in accordance with these Terms

  • All information you provide during registration is accurate, current, and complete

We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion.

By using Bllod, you represent and warrant that:

3. Description of Service

Bllod is a personal health and wellness tracking platform that allows you to:

  • Upload and store medical documents (PDFs, images)

  • Organize and manage your health records

  • Track health metrics (weight, blood work, glucose, sleep, etc.)

  • Visualize your health data over time

  • Export your data for sharing with healthcare providers

3.1 AI-Powered Features

Certain features use artificial intelligence and optical character recognition (OCR) to:

  • Extract data from uploaded documents

  • Categorize and standardize health metrics

  • Identify patterns in your health data

Important: AI-powered features are provided as a convenience and may not be fully accurate. You are responsible for reviewing and verifying all extracted data.

3.2 Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

4. Account Registration and Security

4.1 Account Creation

To use Bllod, you must create an account by providing accurate and complete information. You agree to update your information promptly if it changes.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities that occur under your account

  • Notifying us immediately at bllodhealth@gmail.com if you suspect unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One Account Per User

Each user may maintain only one account. We reserve the right to terminate duplicate accounts.

4.1 Account Creation

To use Bllod, you must create an account by providing accurate and complete information. You agree to update your information promptly if it changes.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities that occur under your account

  • Notifying us immediately at bllodhealth@gmail.com if you suspect unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One Account Per User

Each user may maintain only one account. We reserve the right to terminate duplicate accounts.

5. Subscription Plans and Payments

5.1 Service Tiers

Bllod offers the following subscription tiers:

  • Free

  • Premium

  • Pro

Pricing and features are subject to change. Current pricing is always available within the App.

5.2 Billing and Payment

  • Subscriptions are billed in advance on a monthly or annual basis

  • Payment is processed through Apple App Store or Google Play Store

  • All fees are non-refundable except as required by applicable law or as expressly stated in these Terms

  • You are responsible for any applicable taxes

5.3 Free Trials

We may offer free trials at our discretion. At the end of a trial period, you will be automatically charged unless you cancel before the trial ends.

5.4 Cancellation

You may cancel your subscription at any time through your device's app store settings. Upon cancellation:

  • You retain access to paid features until the end of your current billing period

  • Your account reverts to the Free tier

  • Your data remains accessible; no data is deleted upon downgrade

5.5 Price Changes

We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

6. User Content and Data

6.1 Your Content

"User Content" refers to any files, documents, images, data, or other materials you upload, submit, or store through the Service.

You retain full ownership of your User Content. By uploading content to Bllod, you grant us a limited, non-exclusive, royalty-free license to:

  • Store, process, and display your content to provide the Service

  • Create backups for data protection purposes

  • Process your content using AI/OCR to extract and organize data (if you use these features)

This license exists solely to operate and improve the Service and terminates when you delete your content or account.

6.2 Your Responsibilities

You are solely responsible for:

  • The accuracy and legality of your User Content

  • Ensuring you have the right to upload any content

  • Backing up your own data (we recommend maintaining copies of important documents)

6.3 Prohibited Content

You agree not to upload content that:

  • Infringes on intellectual property rights of others

  • Contains malware, viruses, or harmful code

  • Is illegal, fraudulent, or deceptive

  • Violates the privacy rights of others

  • Contains content you do not have the right to share

6.4 Data Portability

You may export your data at any time through the App's export functionality. We support standard formats to ensure you can take your data elsewhere.

7. Acceptable Use Policy

You agree to use Bllod only for its intended purpose as a personal health tracking tool. You agree not to:

  • Use the Service for any unlawful purpose

  • Attempt to gain unauthorized access to our systems or other users' accounts

  • Interfere with or disrupt the Service or servers

  • Reverse engineer, decompile, or attempt to extract the source code

  • Use automated systems (bots, scrapers) to access the Service without permission

  • Resell, sublicense, or commercially exploit the Service without authorization

  • Impersonate another person or entity

  • Upload false or misleading health information with intent to deceive

  • Use the Service to store content unrelated to health and wellness

  • Circumvent any usage limits or restrictions

Violation of this policy may result in immediate termination of your account.

8. Intellectual Property

8.1 Our Intellectual Property

Bllod, including its name, logo, design, features, and underlying technology, is owned by Yan Guyt Franca and protected by intellectual property laws.

You may not:

  • Copy, modify, or distribute our software or content

  • Use our trademarks without written permission

  • Remove any copyright or proprietary notices

8.2 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without restriction or compensation to you.

9. Medical Disclaimer

BLLOD IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

9.1 For Informational Purposes Only

The Service is designed to help you organize and track your personal health information. It is intended for informational and organizational purposes only.

9.2 Not a Substitute for Professional Care

Bllod does not:

  • Diagnose, treat, cure, or prevent any disease or health condition

  • Replace professional medical advice, diagnosis, or treatment

  • Provide medical recommendations or interpretations

  • Verify the accuracy or clinical significance of your health data

9.3 Consult Healthcare Professionals

Always seek the advice of qualified healthcare providers with any questions regarding your health. Never disregard professional medical advice or delay seeking it because of information displayed in the App.

9.4 AI Accuracy Limitations

Data extracted by our AI/OCR features may contain errors. You must verify all extracted information against your original documents. We are not responsible for any decisions made based on inaccurate extracted data.

9.5 Emergency Situations

If you are experiencing a medical emergency, call your local emergency services immediately. Do not rely on Bllod for emergency medical situations.

10. Third-Party Services

10.1 Third-Party Integrations

The Service may integrate with third-party services (e.g., cloud storage, authentication providers). Your use of such services is subject to their respective terms and privacy policies.

10.2 Third-Party Links

The App may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of any third-party sites.

10.3 App Stores

Your download and use of Bllod is also subject to the terms of the Apple App Store or Google Play Store, as applicable.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose

  • Non-infringement

  • Accuracy, reliability, or completeness of any content

  • Uninterrupted, secure, or error-free operation

  • Accuracy of AI/OCR data extraction

We do not warrant that the Service will meet your requirements or expectations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

12.1 Exclusion of Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data

  • Loss of profits or revenue

  • Personal injury or health outcomes

  • Decisions made based on information in the App

  • Unauthorized access to your account

  • Service interruptions

12.2 Liability Cap

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of:

  • The amount you paid us in the 12 months preceding the claim, or

  • $100,00 USD

12.3 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose and regardless of the theory of liability (contract, tort, or otherwise).

12.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Yan Guyt Franca, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service

  • Your User Content

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Any dispute between you and a third party related to the Service

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

We may suspend or terminate your account immediately, without prior notice, if:

  • You breach these Terms

  • We are required to do so by law

  • We discontinue the Service

  • We believe your actions may cause legal liability or harm to others

14.3 Effect of Termination

Upon termination:

  • Your right to access the Service ceases immediately

  • We may delete your account and User Content after 30 days

  • Provisions that by their nature should survive termination will survive (including Sections 6.1, 11, 12, 13, 15, and 16)

14.4 Data Retrieval

We recommend exporting your data before terminating your account. After the retention period, we are not obligated to maintain or provide your data.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

15.5 Notices

We may provide notices to you via email, in-app notifications, or by posting on the Service. Notices to us must be sent to bllodhealth@gmail.com.

15.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet/infrastructure failures.

15.7 Language

These Terms may be translated into other languages for convenience. In case of conflict, the English version shall prevail.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

  • We will notify you via email and/or in-app notification at least 30 days before changes take effect

  • We will update the "Last Updated" date at the top

  • Continued use of the Service after changes take effect constitutes acceptance

If you do not agree to the updated Terms, you must stop using the Service and delete your account.
